Myron Blaine Strait, the plaintiff in error (hereinafter defendant), was found guilty by a jury of burglary, sec. 943.10 (1), Stats., and after post-trial motions and a presentence investigation was sentenced to three years at the State Reformatory at Green Bay. The sentence was to be served consecutively to the remainder of a sentence upon which parole had been revoked. Thereafter appointed counsel (not his trial attorney) obtained this writ of error in behalf of the defendant.
